Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using https://tribebx.co/ (“the Site”) operated by Tribe Boxing Studio Sdn. Bhd. (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://tribebx.co/.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for your use of Tribe Boxing Studio Services. You are only authorized to use the Tribe Boxing Studio Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully and save it. If you do not agree with it, you should leave the Tribe Boxing Studio website and discontinue use of Tribe Boxing Studio Services immediately. If you wish to become a Member, you must read these Terms of Service and indicate your acceptance during the registration process. ​

ACCOUNTS
In order to access some features of the website, you will have to create a TRIBE account. You may never use another person’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account. ​

TRIBE HOUSE RULES & POLICIES ​

CLASS CANCELLATIONS:
You must cancel your class 12 hours in advance, or you will be deducted a class credit. This includes switching time slots under the 12-hour notice time period. You may cancel your class through our online system or by calling the applicable studio directly.

LATE POLICY:
A strict no-late policy is implemented at TRIBE and there will be no grace period given to the late-comers. If the reserved class has begun, you will be denied entry to the class and your credit will be considered used.

REFUND POLICY:
All class and personal training package sales are final and non-refundable. You should be aware that classes do expire. The expiration dates are posted in the description of the class or series of classes on our website. Classes that are canceled LESS THAN 12 hours in advance will be charged in full to the client. Please check our FAQ page for more details. Note that purchases may be processed by third-party vendors. All credits are NOT for resale. Any person, site or service deemed to be reselling class and or personal training credits will forfeit all credits and no refund shall be given. TRIBE reserves the right to ban any person and or entity deemed to have violated the aforementioned and sole determination of such violation is at the complete discretion of TRIBE.

PERSONAL BELONGINGS:
You agree that TRIBE is in no way responsible for the safekeeping of your personal belongings when you are present in the studio. You assume all risk of loss for any of your personal belongings. ​

GENERAL
Tribe Boxing is committed to the health, safety, and welfare of each of its members and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behaviour. Members who do not observe Tribe Boxing’s rules and regulations or who abuse equipment in any fashion will be asked to leave. Tribe Boxing has the right to judge behaviour and respond accordingly. This right includes, but is not limited to termination of a membership without refund to members engaging in unacceptable behaviour. The said member shall pay for any damages to Tribe Boxing property which results from the willful or negligent conduct of any participating member or member's guest. Tribe Boxing reserves the right to add, change or remove rules, conditions of membership, prices of group class and personal training. ​

WAIVER & RELEASE
In consideration of the services of TRIBE BOXING SDN BHD (1248411-X) (“company”) in relation to the provisions of the use of space at TRIBE located at Arcoris Mont Kiara and Tropicana Gardens Mall (“Premises”) and/or m being allowed to participate in the activities being carried on in the Premises, including any classes, program, training, instruction or event (“Activities”), and/or use of facility or equipment therein (“Equipment”), whether provided by the company or otherwise the company’s officers, employees, agent, affiliates, contractors, representative, assigns or successors (“Associates”), I, the undersigned, hereby expressly and voluntarily agree as follows: Declaration, I hereby declare myself to be physically sound and suffering from no condition, impairment, disease or other illness that would prevent my participation in the activities and/or use of the equipment. I understand that in the event of an accident or injury, personal judgment may be required by the company’s employees, agents, representatives or volunteers regarding what actions should be taken on my behalf. Nevertheless, I acknowledge that the company and/or by the company’s personnel does not legally owe me a duty to take any action on my behalf. I also understand that it is my responsibility to secure personal health insurance in advance, if desired. Assumption of Risk I hereby acknowledge full understanding of the possibility of inherent dangers, risks and hazards associated with the activities and/or use of the equipment. I further acknowledge that it is my responsibility to have a physical examination and obtain my physicians permission prior to participating in the activities and/or using the equipment and do hereby assume all risk of injury, illness, death, damage or loss to myself or my property that i may suffer while and/or resulting from using the premises or the equipment, or participating in the Activities, whether arising out of active or passive acts of negligence, action or inaction, on the part of the Company or the Associates. Waiver and Release I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold harmless the company and the associates (“Releasees”) from any and all claims, demands, damages, rights of action or causes of actions, present or future, arising out of my use of the premises and/or the equipment, and/or my participation in any of the Activities occurring in the Premises, including any injuries arising from the negligence of the Releases or otherwise, to the fullest extent permitted by law. ​
